This paper looks at transgender identities and the law in the context of marriage in common law jurisdictions. It particularly focuses on the nature and sources of authority over word meaning as well as the role of language and definition in classifying transgender individuals into a legal category. When it comes to the legal question of who may marry whom, and what the terms “man” and “woman” actually refer to, there is no statutory definition of the terms “man”, “woman”, “male” (...) and “female”. This has put the onus on judges, especially those who needed to decide whether a transgender person can marry in his/her affirmed sex, to interpret these terms. Two lines of cases in transgender jurisprudence are examined so as to have a close study of how the courts construed these terms and classified transgender people into a category. The first concerns United Kingdom cases, namely Corbett v Corbett, Bellinger v Bellinger and the Hong Kong case W v Registrar of Marriages, &. The second consists of Australian cases such as Secretary, Department of Social Security v State Rail Authority and Re Kevin. This paper discusses these issues by analyzing and comparing different cases in transgender jurisprudence as well as examining how these issues play out in contemporary Hong Kong. (shrink)

We conduct a laboratory experiment using the Monty Hall problem to study how simplified examples improve learning behavior and correct irrational choices in probabilistic situations. In particular, we show that after experiencing a simplified version of the MHP, subjects perform better in the MHP, compared to the control group who only experienced the 3-door version. Our results suggest that simplified examples strongly induces learning.

This article reports on the evolution of breakdance. Given the inclusion of breakdancing in the 2024 Olympic Games in Paris, France, scholars have generated substantial international research related to breakdance teaching in recent years. However, few researchers have focused on the impact of formal formative assessment on breakdance teachers’ teaching and students’ learning. We wish to contribute to the quality of breakdance teaching and learning by identifying the positive impact of recent research on formative assessment on student learning and designing (...) a formal formative assessment task related to breakdance. This article lays out a framework of formal formative assessment tasks and identifies the positive impact of formative assessment on dance education. Although our work is far from perfect, it does provide a general methodological framework for assessing breakdance students’ abilities in formal educational settings. (shrink)

This review examined the studies on the role of technology-based English as a foreign language academic motivation. A significant positive correlation between academic motivation and educational technology use has been approved in related studies. However, there is a dire need for studying the effect of Mobile-Assisted Language Learning and Computer-Assisted Language Learning on learners’ motivation. The literature showed that purposeful attractiveness, effectiveness, and usefulness of digital instruments can positively affect learner motivation. There are also some reasons for increasing learner motivation (...) in educational technology contexts, such as learners’ integration with the community, familiarising with different societies and cultures, input flooding opportunities, engagement in academic contexts, and interaction with native speakers. In the end, the paedagogical implications are expounded to promote the learners’ grit and diminish anxiety for better performance. This review also provides suggestions for further research to clarify our perspective on emotional variables like motivation. (shrink)

An increasingly worrying trend is enterprises undertaking greenwashing rather than producing actual green products. When such greenwashing behaviours are exposed, green brand trust between enterprises and stakeholders may be damaged, resulting in stakeholders becoming suspicious of these supposedly green brands. Then, enterprises need to adopt several trust repair strategies to repair the damaged green brand trust. We investigated green brand trust repair from a green brand legitimacy perspective and found the following: (1) higher green brand legitimacy suggests the use of (...) considered informational, emotional and corrective repair strategies. (2) Meanwhile, lower green brand legitimacy requires the use of timely informational, emotional and corrective repair strategies. Using the correct set of repair strategies may provide practical and effective approaches for enterprises to repair their brand trust. (shrink)

The number of articles published in open access journals has increased dramatically in recent years. Simultaneously, the quality of publications in these journals has been called into question. Few studies have explored the retraction rate from OAJs. The purpose of the current study was to determine the reasons for retractions of articles from OAJs in biomedical research. The Medline database was searched through PubMed to identify retracted publications in OAJs. The journals were identified by the Directory of Open Access Journals. (...) Data were extracted from each retracted article, including the time from publication to retraction, causes, journal impact factor, and country of origin. Trends in the characteristics related to retraction were determined. Data from 621 retracted studies were included in the analysis. The number and rate of retractions have increased since 2010. The most common reasons for retraction are errors, plagiarism, duplicate publication, fraud/suspected fraud and invalid peer review. The number of retracted articles from OAJs has been steadily increasing. Misconduct was the primary reason for retraction. The majority of retracted articles were from journals with low impact factors and authored by researchers from China, India, Iran, and the USA. (shrink)

Research on knowledge hiding has largely focused on its antecedents while overlooking its consequences. Drawing on moral cleansing theory, we adopt a “perpetrator-centric view” and posit that employees who engage in playing dumb and evasive hiding–two specific knowledge hiding behaviors that involve deception–will subsequently perform more organizational citizenship behavior directed toward individuals (OCB-I) because they perceive a loss of moral credits following their moral transgression. Further, we propose that the indirect effects are contingent on perpetrators’ moral identity internalization. We tested (...) our hypotheses using a time-lagged research design with a sample of 362 respondents from a large pharmaceutical group company. Consistent with our hypotheses, we found that employees who engaged in playing dumb and evasive hiding subsequently exhibited more OCB-I as they perceived a loss of moral credits, whereas employees who engaged in rationalized hiding did not. In addition, the positive relationships between playing dumb and evasive hiding with perceived loss of moral credits were stronger when perpetrators had high moral identity internalization, as were the indirect effects of playing dumb and evasive hiding on OCB-I via perceived loss of moral credits. Our research contributes to the understanding of when and how engaging in knowledge hiding affects perpetrators and their compensatory behaviors toward coworkers. (shrink)

ObjectiveBasic combat training is a kind of necessary high-intensity training to help each military recruit convert into a qualified soldier. In China, both the physical fatigue and passive psychological state have been observed in new recruits during BCT. However, after same-intensity training, the degree of fatigue and passive mood vary among recruits. Therefore, this study aimed to explore the effect of BCT on mood state of recruits with different physical fitness levels from a perspective of fatigue.Materials and methodsBefore and after (...) BCT, the degree of fatigue and mood state of participants were evaluated via the Borg Rating of Perceived Exertion Scale and Profile of Mood States Questionnaire immediately after 20 push-ups as RPE and POMS scores [total mood disturbance, passive mood and positive mood ]. The participants were divided into two groups according to the RPE score measured after BCT: group 1: RPE score after BCT < 13 and group 2: RPE score after BCT ≥ 13.ResultA total of 564 recruits were included. After BCT, in group 1, TMD and passive mood Ttension, Tfatigue, Tdepression, Tconfusion declined significantly, but positive mood both increased significantly ; while in group 2, only Tanger and Testeem increased significantly.ConclusionBCT could alleviate passive mood and add to positive mood for recruits with better physical fitness, while had no ameliorative effects on or even deteriorate most of the passive mood for recruits with worse physical fitness. African American adolescents have become more active users of digital media, which may increasingly expose them to direct online discrimination based on their racial and gender identities. Despite well-documented impacts of offline discrimination, our understanding of if and how direct online discrimination affects African American adolescents similarly remains limited. Guided by intersectional and ecological frameworks, we examined the association between direct online discrimination and internalized computing stereotypes in African American adolescents. Further, we explored the moderating effects of systemic and individual (...) factors – vicarious online discrimination, parental technological attitudes, and racial identity centrality – on this association by adolescent gender. Utilizing data from 1041 African American parent-adolescent dyads, we found a positive association between adolescents’ direct online discrimination and internalized computing stereotypes. Surprisingly, greater vicarious online discrimination mitigated this association for both male and female adolescents. Further, parental technological attitudes and racial identity centrality mitigated this association only for female but not male adolescents. Our findings highlight the importance of understanding the impact of media on adolescents’ online experiences from intersectional and systemic perspectives. We discuss the implications for prospective research and educational programs focused on African American adolescents’ digital media use and online experiences. (shrink)

Happiness, defined as a state of well-being and contentment, is a central human goal. Despite advances in customer behavior research related to value co-creation, the link between customer happiness and these behaviors remains unclear. This study therefore examines customers’ in-role participation behavior and extra-role citizenship behavior to determine their influence on customers’ happiness. Customer participation and citizenship behaviors relate positively to customers’ perceptions of both service performance and their contributions to others’ welfare. In addition, collectivism moderates the relationship between perceived (...) contributions to others’ welfare and happiness; individualism instead moderates the relationship between perceived service performance and happiness. These findings provide both managerial implications and directions for business marketing ethics. (shrink)

Time is a necessary element in understanding AI art. Firstly, time reveals the historical process by which art-theoretical predicates move from the unmarked to the marked, which can thus be utilized as a defense for arguing the legitimacy of AI art as art. Furthermore, AI art should be seen as a “new” art that is temporally ahead of the descriptive forms of art theory. Secondly, time provides a unique interpretation of AI artworks’ characteristics and aesthetic experience. The absence of experience, (...) the de-depth of AI artworks, and the “short experience/short memory” aesthetic mode of the masses are closely linked to the scarcity of time in an age of acceleration. Finally, time reflects the loss of “aura” and the new end of art that AI art may bring about. Time provides a defense and explanation of AI art, as well as a perspective for reflecting on the development of art in contemporary times. (shrink)

In the current performance evaluation works of commercial banks, most of the researches only focus on the relationship between a single characteristic and performance and lack a comprehensive analysis of characteristics. On the other hand, they mainly focus on causal inference and lack systematic quantitative conclusions from the perspective of prediction. This paper is the first to comprehensively investigate the predictability of multidimensional features on commercial bank performance using boosting regression tree. The dimensionality in the financial-related fields is relatively high. (...) There are not only observable price data, financial fundamentals data, etc., but also many unobservable undisclosed data and undisclosed events; more sources of income cannot be explained by existing models. Aiming at the characteristics of commercial bank data, this paper proposes an adaptively reduced step size gradient boosting regression tree algorithm for bank performance evaluation. In this method, a random subsample sampling is performed before training each regression tree. The adaptive reduction step size is used to replace the reduction step size setting of the original algorithm, which overcomes the shortcomings of low accuracy and poor generalization ability of the existing regression decision tree model. Compared to the BIRCH algorithm for classification of existing data, our proposed gradient boosting regression tree algorithm with adaptively reduced step size obtains better classification results. This paper empirically uses data from rural banks in 30 provinces in China to classify the different characteristics of rural banks’ performance in order to better evaluate their performance. The effect of authentic leadership and leader competency on employee job performance has received growing attention in the past decades; however, few studies have simultaneously integrated these two leadership perspectives. We have thus developed a mediated moderation model to test the interactive effect of authentic leadership and competency on followers’ job performance through work engagement. Based on a sample of 248 subordinate–supervisor pairs, hierarchical regression analyses reveal that authentic leadership positively relates to followers’ task performance and organizational citizenship behavior ; (...) leader competency moderates the relationship between authentic leadership and OCB; and followers’ work engagement mediates the main effect of authentic leadership and the interactive effect of authentic leadership and competency on followers’ task performance and OCB. Gender differences in science and engineering have been studied in various countries. Most of these studies find that women are underrepresented in the S&E workforce and publish less than their male peers. The factors that contribute to gender differences in experience and performance in S&E careers can vary from one country to another, yet they remain underexplored. This paper is among the first to systematically compare gender differences in the publication productivity of academic scientists and engineers with doctoral degrees in (...) the U.S. and China. Findings from negative binomial regressions show that women publish less than their male counterparts in science but not in engineering in the U.S. In China, women do not differ from men in publication productivity in science but publish more than their male counterparts in engineering. In addition, we find that some background variables affect men’s and women’s publication productivity differently. The findings are analyzed in the context of the different cultures of the two fields and of the two countries. Limitations and policy implications are also discussed. (shrink)

Internet addiction is a growing social problem with negative mental and social outcomes; the present study examined whether rejection sensitivity mediates the relationship between interparental conflict and adolescent IA and the moderating role of school connectedness. One thousand and seven adolescents anonymously completed questionnaires to assess interparental conflict, school connectedness, rejection sensitivity, IA, and demographic information. The model results showed that: the positive association between interparental conflict and adolescent IA was partially mediated by rejection sensitivity; this indirect link was moderated (...) by the school connectedness and was stronger for adolescents with high school connectedness. The results provide support for the attachment theory that high interparental conflict could increase adolescents’ rejection sensitivity, and high school connectedness plays a double-edged role that adolescents show more rejection sensitivity while reporting high interparental conflict and high school connectedness. This cross-sectional study investigated the relationships between teacher mindfulness, work engagement, and classroom emotions composed of positive and negative emotions. A sample of 498 Chinese primary, secondary, and high school teachers completed an anonymous online questionnaire. Descriptive analysis, bivariate correlation, and a series of regression equations were conducted to analyze the data. The results indicate that teacher mindfulness, work engagement, and classroom emotions are all at the intermediate level, and significantly correlated. The effect of teacher mindfulness on classroom emotions is (...) partially mediated by work engagement. In addition, negative emotions partially mediate the effect of teacher mindfulness on work engagement, while positive emotions fully mediate it. These results highlight the importance of fostering teacher mindfulness through mindfulness-based intervention, developing teacher emotion regulation competence in teacher education, and cultivating supportive classroom and school culture for teachers to experience more positive emotions from students and administrators. Communication, as a discipline that generates a rich body of literature on CSR, has become a critical contributor to CSR knowledge in social science. However, limited research exists to understand how CSR knowledge is constructed and diffused in the discipline. This study thus intends to unpack the knowledge construction process of CSR research in the communication discipline from a network perspective. Invisible college was adopted as the conceptual framework. Article and theory/concept networks were constructed with 290 peer-reviewed articles from 61 (...) communication journals between 1980 and 2018. Results showed that in the past four decades, CSR literature in communication has been growing and maturing, as evidenced by the increasing volume and diversity of theories and concepts applied. Furthermore, this body of literature tends to gravitate toward certain selected groups of theories and concepts, resulting in denser article networks over time. Our findings reflected a substantial influence of management and psychological perspectives on CSR research in communication. Additionally, the results showed that public relations concepts and theories have influenced CSR research across different communication subfields such as advertising and organization communication. The study expects the continuation of the plurality of voices as to how communication researchers will approach CSR and what specific topics may gain popularity in future research. (shrink)

Although stressful life events have been shown to be a key risk factor for adolescent NSSI, the potential mediators and moderators of this relationship are unclear. Based on the social development theory and the organism-environment interaction model, we tested whether the link between stressful life events and adolescent NSSI was explained in part by deviant peer affiliation, and whether this process was buffered by gratitude. Chinese adolescents anonymously completed questionnaires to assess the study variables. The present study demonstrated that stressful (...) life events was linked to NSSI in part because of deviant peer affiliation, and high gratitude was a key protective factor to buffer this indirect effect. Teaching gratitude may be a helpful component of prevention and intervention programs to reduce adolescent NSSI. (shrink)

This paper aims at investigating the dynamic characteristics of a microring driven by dual arch electrodes because they are basic elements of microelectrostatic motors. The dual arch electrodes surround the periphery of the microring and are arranged symmetrically to the center of the ring. The electrodes are fixed while the microring is flexible. The electrostatic force will deform the microring, while the deflection of the microring changes the gap between the microring and the electrodes, thereby changing the electrostatic force. Therefore, (...) this is an electromechanical coupling effect. The nonlinear partial-differential equation that governs the motion of the microring is derived based on thin shell theory. Then, based on the assumption of small deflection, the nonlinear governing equation is linearized by truncating the higher-order terms of the Taylor series expansion of the nonlinear electrostatic force. After that, the linearized governing equation is discretized into a set of ordinary differential equations using Galerkin method in which the mode shape functions of the ring are adopted. The influences of the structural damping of the microring and the span of the arch electrodes on the forced response and dynamical stabilities of the microring are investigated. The results show that the damping ratio has a great influence on the system instability during high-frequency excitation. The unstable region of the system can increase with the increase of the electrode span; the response amplitude can also be increased within a certain range. (shrink)
